It's unfortunate but some of us sportbike riders will have an accident; might be me, might be you. Thats why I want to go over some things you need to do when that that terrible time comes.
Here are some key points that we should all know.
The crash:
Picture this; youre out riding your bike, its about 72 and sunny. Just as things are feeling good a cager pulls out of the Wendys parking lot right in front of you and you slam right into the front driver side fender. The fat lady that smells like chicken nuggets runs over to see if youre o.k. You look around through a cloudy head pounding haze and see your sportbike laying in pieces. For most its a sad, life changing moment and youre just thankful that your still in one piece and breathing.
The After Crash:
Now you have a mangled motorcycle and your stuck in a hospital. The bitchy nurse that you overheard talking about how much she loves Britney spears is saying that they need to cut off your $1200 leathers, it cant possibly get any worse.
This is where you must know what to do. You obviously have some injuries and the lady you hit is at home shoveling food in her mouth thinking to herself damn bikers, its so hard to see them.
What to do after an injury:
You or someone you know, like a family member or friend, needs to get a hold of a lawyer. One that specializes in motorcycle accidents.
Photographs:
After your initial medical care, have pictures taken of your injuries. Your attorney can help you with this if contacted right away or you can have a family member or friend do it as well. Pictures should also be taken of any other factors involved in the accident, including motor vehicles, motorcycles etc.
Statements:
Unless you have to give a statement to the police, do not give a written or recorded statement to anyone else. These parties include insurance companies and/or their investigators. Your motorcycle lawyer can arrange for a statement, if necessary, after fully preparing you, and attending the interview with you to object to any improper questions. Your attorney understands how to analyze liability and how to properly characterize your case for maximum advantage.
Recall the Incident:
Try to write down all the facts about the accident that you can remember. Retain anything of yours involved in the accident such as your motorcycle or helmet, torn clothes, etc. This evidence is helpful and may aid in accident reconstruction.
Get Contact Information:
If possible, obtain contact information for all witnesses. If you are unable to get this information because of your injuries, your attorney or someone you know can help you. Its best to get witness statements sooner rather than later.
It is critical to have a lawyer who understands your injuries and how they might affect you. This is why you should try to contact one that is a motorcycle accident specialist like me. Because we deal with this stuff every day.
